2022年6月16日，由中国海事仲裁委员会主办的2022中国海事商事仲裁高级别对话会在京举行，嘉宾云集，高朋满座，成果丰硕。

仲裁热点法律问题吸引眼球
在北京霖理律师事务所主任张玉林主持下，奥地利Baier律师事务所顾问Arthur WOLFF、上海政法学院助理教授Adolf PETER、中国人民大学法学院助理教授Stephen LEONARD、中国海事仲裁委员会副主任李虎博士、上海仲裁委员会副秘书长陈建博士分别就仲裁程序透明度及仲裁裁决的执行、人工智能在仲裁程序中的应用、线上庭审的可行性与必要性和国际仲裁中的第三方资助仲裁以英文交流研讨。
海事热点问题热度不减当年
在大连海事法院原副院长关正义教授主持下，大连海事法院副院长孙光、中国海仲浙江仲裁中心顾问吴勇奇、上海海事大学法学院海商法研究中心主任胡正良、大连海事大学法学院副院长朱作贤、上海威颂律师事务所主任郑田卫就海商法下港口经营人相关权利义务的修法必要性和可行性、目的港运输货物交付的合同义务与法律责任、企业破产下船舶优先权的实体和程序性权利的保护等以中文分享智慧，海事热点问题持续受到各方关注。
商事法律热点问题经久保温
在中国人民大学法学院教授、博士生导师刘俊海的主持下，北京大学法学院教授及博士生导师刘凯湘、中国政法大学教授王毓莹、兰台律师事务所高级合伙人姚晓敏、通商律师事务所合伙人崔强围绕股权代持的效力、PE/VC与目标公司签署的对赌条款的效力、股权转让过程中股权变动的时点等热点问题以中文交锋，气氛热烈。
对话会在中国海事仲裁委员会副秘书长陈波博士的闭幕词中圆满落幕。

Good Morning!
How time flies! The 2022 China High-level Dialogue on Maritime and Commercial Arbitration was held today. The grand opening of the 2021 China High-level Dialogue on Maritime and Commercial Arbitration held on July 16, 2021 is still vivid in my memory as if it happened yesterday.
As the 30th President of the IPBA, I would like to extend my warm congratulations on this Forum!
With more than 60 years of arbitration practice, thousands of professional arbitration cases, most of which are international cases have been heard by the CMAC independently and impartially. It has become the second largest maritime arbitration institution in the world.
The Inter-Pacific Bar Association was established in April 1991. After more than 30 years of development, the IPBA has become a major international lawyer association, and has successively held Annual Meeting & Conferences in Hong Kong SAR, Beijing and Shanghai in 2002, 2007, 2015 and 2021 respectively.
As the first local lawyer to serve as the head of a major international lawyer organization since Shanghai opened up 177 years ago, I took office as the 30th President of the IPBA on June 7, 2020. I completely feel the unique charm and influence of CMAC in the international arbitration industry, and I’m deeply grateful to CMAC for its strong support to our Association!
Charm One: Responsibility and Making Voice Heard at Key Moment
Despite the pandemic of COVID-19, the IPBA held four high-end international sessions in China in 2021, mainly onsite with some virtual, three sessions of which are strongly supported by CMAC.
The first event of the 30th Annual Meeting & Conference, held on April 19, was full of splendor.
This Annual Meeting & Conference attracted over 600 lawyers from more than 30 countries and regions around the world focusing on the Reform of International Economic and Trade Rules and the Opportunities and Challenges of the Legal Industry, discussing the Regional Comprehensive Economic Partnership Agreement and opportunities for the Asia Pacific International Arbitration Center. Mr. Tang Yijun, Minister of the Ministry of Justice of the People's Republic of China, Mr. Li Fei, Chairman of the Constitution and Law Committee of the National People’s Congress, Mr. Gong Zheng, Mayor of Shanghai attended the opening ceremony and delivered speeches. Mr. Xiong Xuanguo, Vice Minister of the Ministry of Justice, delivered a keynote speech on the topic of Persist in High-Quality Development and High-level Opening and Strive to Build a World-Class Arbitration Institution. Nearly 200 senior international arbitrators and experts, including Mr. Zhou Hanmin, Vice Chairman of the Shanghai Municipal Political Consultative Conference, Mr. Li Hu, Vice Chairman of CMAC gave very wonderful onsite keynote speeches and online speeches, and presided over 27 concurrent sessions including the Development of Digital Trade.
This Annual Meeting of the IPBA, held at its 30 years old, ushered in the holding international rule of law and lawyer forum by way of onsite and virtual sessions. The book At Thirty I Stand Firm, one of the fruits of this Annual Meeting, is now available to the readers of the world.
Mr. Liu Zhiqiang, Vice Minister of the Ministry of Justice of the People’s Republic of China, commented in his article Improving the Foreign-related Legal Service System to Improve Foreign-related Legal Service Capability in the 18th issue of Democracy and Legal System (2022), that "lawyers' participation in international organization activities has achieved initial results. More and more outstanding foreign-related lawyers have been recommended to serve in international organizations. The 30th Annual Meeting & Conference of the IPBA was successfully held in Shanghai to publicize Xi Jinping Thought on the Rule of Law and Chinese great achievements in comprehensively governing the country in accordance with the law, as to expand the international influence of Chinese lawyers.”
The second meeting of the East Asia Forum was hosted by the CMAC and co-organized by the Tianjin Lawyers Association, and achieved fruitful results.
Vice Chairman Li Hu delivered an impressive speech. Arbitration experts from CMAC and maritime commercial arbitration experts from the IPBA gathered in Tianjin to focus on the revision of Chinese Arbitration Law. The results of the meeting have been included in the book Wisdom Gather in Tianjin and published to the circles.
The third meeting of IPBA of Guangzhou Arbitration Day was met with applause.
Mr. Li Fei, Chairman of the Constitution and Law Committee of the National People's Congress, and Mr. Xiong Xuanguo, Vice Minister of the Ministry of Justice, delivered video speeches. Vice Chairman Li Hu delivered a very exciting keynote speech at the main forum, and put forward unique insights on the prospect of international arbitration in the Greater Bay Area. The results of this meeting were recorded in the book Full Passion of Guangzhou, which has become a beautiful memory for all those who love arbitration.
Charm Two: Leading Innovation to Initiate the Ad hoc Arbitration
On March 18, 2022, CMAC issued the Rules as Appointing Authority in Ad hoc Arbitration, which was synchronized with the Ad hoc Arbitration Rules issued by the China Maritime Law Association, and jointly took the lead in developing ad hoc arbitration services. This "China first" initiative plays an important leading role in promoting the development of ad hoc arbitration in China, and is conducive to enhancing the industry's voice and international influence.
The first goal of the ad hoc arbitration of CMAC is so wonderful, the strength is well-deserved!

As the former Secretary-General of the United Nations, Mr. Ban Ki-moon mentioned at the opening ceremony of the 30th Annual Meeting and Conference of the IPBA, the rule of law is an important achievement and common language of human civilization. The Inter-Pacific Bar Association, in the 30 years since its development, have carried out effective legal research and legal services with top commercial lawyers along the Pacific Ocean in many legal fields such as cross-border investment, dispute resolution and arbitration, finance and capital markets, energy and natural resources, intellectual property, international trade, maritime business and aviation. It has also played an important role in the development of the system of international rules.
Since its establishment 31 years ago, the IPBA has been committed to strengthening the cooperation, exchanges and mutual learning among lawyers in the Inter-Pacific region and lawyers from countries and regions interested in business activities in the Inter-Pacific region, working hand in hand to provide legal support and legal services to various economies. In 2023, 2024 and 2025, the Annual Meeting of IPBA will be held in Dubai, Tokyo and Chicago, respectively. Here, we sincerely welcome all experts to register.

弹指一挥间，由中国海仲携手仲裁界和律师界多家机构精心打造的2022中国海事商事仲裁高级别对话会今天隆重举行，2021年7月16日中国海事商事高级别研讨会盛大开幕的场景还历历在目，记忆犹新。
作为环太平洋律师协会第30届会长，我向本次会议的举办表示热烈的祝贺！
中国海仲历经60多年的仲裁实践，独立公正地审理裁决案件数千件，已成为世界第二大海事仲裁机构。
环太平洋律师协会成立于1991年4月，是国际首家诞生在亚洲的国际律师组织。经过30多年的发展，环太律协已经成为国际主要律师组织，并先后四次在中国香港特别行政区、北京和上海举办年会。
2020年6月7日，作为上海开埠177年来首位任职国际主要律师组织负责人的本土律师，我担任了环太律协第30届会长。在我任职的近2年时间里，我深感中国海仲在国际仲裁业界的独特魅力和影响力，深深感谢中国海仲对环太律协的鼎力支持！
魅力之一：担当作为，关键时点发声
在新冠肺炎疫情持续肆虐的背景下，2021年环太律协在中国举办了4场以线下为主结合线上的高端国际论坛，其中三场得到中国海仲的大力支持。
首场4月19日开幕的第30届年会精彩纷呈。
中国司法部部长唐一军、全国人大宪法和法律委员会主任委员李飞、上海市市长龚正等出席年会开幕式并致辞，司法部副部长熊选国以《坚持高质量发展高水平开放 努力打造国际一流仲裁机构》为题发表主题演讲。上海市政协副主席周汉民、中国海仲副主任李虎等近200名国际资深仲裁员和专家分别作了十分精彩的线下主题演讲、线上演讲和主持了《数字贸易的发展》等27个论坛。
环太律协三十而立的年会开启疫情下全球首例以线下为主结合线上的国际法治和律师论坛之先河。年会的成果已由《三十而立》一书向全球发布。
中国司法部副部长刘志强先生在2022年第18期《民主与法制》周刊中以《健全涉外法律服务体系 提升涉外法律服务能力》为题撰文，指出“律师参加国际组织活动初显成效。近年来，越来越多优秀涉外律师人才获推荐进入国际组织任职。环太平洋律师协会第30届年会在上海成功举办，宣传习近平法治思想和我国全面依法治国伟大成就，扩大我国律师国际影响力。”
第二场中日韩东亚区域会议由中国海仲承办、天津律协协办，成果丰硕。
李虎副主任的开幕致辞和各路专家聚焦中国《仲裁法》的修法建言使本次论坛取得圆满成功。会议的成果已载入《智荟天津》一书，向业内外发布。
第三场环太律协广州仲裁日活动，掌声四起。
全国人大宪法和法律委员会李飞主任和司法部副部长熊选国发表视频致辞，李虎副主任在主论坛就大湾区开展国际仲裁的前景提出了独到的见解。本次活动的成果载入《情满羊城》一书，成为历史留在所有爱好仲裁的人士的美好记忆里。
魅力之二：引领创新，临时仲裁破局
2022年3月18日，中国海仲发布《临时仲裁服务规则》，与中国海商法协会《临时仲裁规则》同步衔接，共同率先开展临时仲裁服务。这一“中国第一”的举措对于促进临时仲裁在中国的发展具有重要的引领作用，有利于提升行业话语权和国际影响力。
中国海仲临时仲裁第一球进得如此精彩，实力所在，当之无愧！

正如联合国原秘书长潘基文在环太律协第30届年会开幕式上致辞所述，“法治是人类文明的重要成果和共同语言。诞生在亚洲的环太律协30年来，团结环太平洋沿岸的顶尖商业律师在跨境投资、争议解决与仲裁、金融和资本市场、能源与自然资源、知识产权、国际贸易、海商航空等诸多法律领域开展卓有成效的法律研究和法律服务，在参与国际规则体系建设中也发挥了重要作用。”
成立31年来，环太律协致力于加强环太平洋地区的律师以及对环太平洋地区商业活动感兴趣的各国各地区律师合作交流和互鉴互学，携手同行为各经济体提供法律支持和法律服务。2023年、2024年和2025年，环太律协将先后在迪拜、东京和芝加哥举办年会。在此，竭诚欢迎各位专家参会指导。
